I guess he does not realize Ebay can read all the emails between the two of you that were made in their system. His story does not match what he stated in the emails, as he admits he did not send the catalog (and still has it because he has another jabba set). In the resolution center he is implying the "Supposed " missing catalog infering that your lying. What a loser.

I agree Todd is there anyway you can highlight that to eBay Craig?

Cheers Jay

Hi Craig

The guy is just digging himself a deeper hole.

He makes out that he didn't check to see if the catalogue
was in the package, he then makes out that it isn't rare
and yet won't post it to you Rolling Eyes

HE IS A FIRST CLASS SCAMMER.

I really hope you come out of this with the refund you are asking
for. You are patient and articulate in your wording of the claim
through ebay.

Good luck..

Ebay carnt access messages between people on Ebay, If you make referance to it they request a copy of the email including full headder sending to them, I had big argument over those fake weapons i bought last month and he admitted in his message that they had not been sent on 6.30 friday night but another message at 8.30 saturday morning he claimed to have sent them. I had to forward on the emails you get with the details on for them to be able to read it.

Gents:

Thank you for all the kind comments, support, and help that you have given to me through this post and for all the PMs. I really appreciated it all.

Ebay made a final decision on my case earlier today and decided in my favour. I was found to be in the right and not overreacting.

However the outcome is not as good as I wanted. Ebay will want me to return the playset in order for them to issue a full refund to me.
As this will be at my own cost and I run the risk of the seller being tempted to tell further lies that he didn’t receive the Playset in my package, I will keep Jabba.

I know that keeping the Playset does mean the Seller will get away with what he has done. But it is - despite being battered and scalped by the seller, a cracking piece and it will be given more love in my collection than the seller ever showed it.

I was speaking to Andy yesterday about his experience and to be honest life is too short to worry about this being drawn out for up to 6 months.

I would still really like to restore this Playset though!

If anyone has a spare Dual Language ROTJ mini catalogue to help me finish the piece, I would be really grateful if they could contact me!
As promised here’s the final coverage of ebay dispute process and their final statement:

Dear welshboy_craig,

We appreciate you writing eBay in regard to item #400133165632. It can
create a very frustrating experience when an item arrives differently
than described in the listing. I would like to thank you for your time
and patience you have shown through this claim process.

I have good news! After reviewing the case, we have decided to have you
return the item to the seller for a full refund! This means you will be
refunded the cost of the item and the original shipping to you. Please
be aware that the return shipping cost will be your responsibility and
will not be included in the refund.

At this time we ask that you send the item out and upload the tracking
information for the shipment to the case within the next 7 days. You can
get the seller's shipping address as well as shipping instructions in
the Resolution Center.

It is important for you to know that the case will be closed
automatically and no refund can be issued if tracking information is not
added to the case within 7 days. Also, if the purchase price of this
item was over $250 you will need to get signature confirmation for the
shipment.

When the tracking number shows the item has been successfully delivered
to the seller, our system will automatically issue you a refund.

Here are the steps to upload tracking information:

1. Hover over ?Help? in the top right corner of the page
2. Select ?Resolution Center? from the drop-down menu
3. Click "Take Action" to the right of the case
4. Click the blue ?Respond to case? button
5. After selecting ?Provide a tracking number?, click on ?Enter tracking
number?
6. Input the tracking number and shipping carrier (such as UPS, Fedex,
etc.) into the relevant boxes
7. Click "Submit"

We appreciate your patience and cooperation and thank you for being a
valuable member of the eBay community!

Sincerely,
Rommel L.

Additional message: Offer by Seller is of $10 is totally
disproportionate and unfair. I have sought expert opinion from

Collector?s Forum and my claim is not over the top. Please see the Forum

The seller can just send me the catalogue he has stolen from my Toy if
he doesn't want to pay the cost of replacing it. All I want at the end
of the day is the complete Playset that I paid for!

I must point out USPS didn?t damage my item. I said the Seller squashed
it in to a shipping container that was smaller than the actual Toy's box
which is why the Toy?s packaging got crushed. Again see my posted
photo?s to compare depths. Even if USPS tip-toed the package to me The
Playset inside would have arrived squashed as seen.

I trust Ebay to decide wisely.

Craig.

I have been brought up to always try & do the right thing- but it's times like this that I'd be tempted to send the seller a boxed lump of wood & give ebay the tracking number Mad

I wouldn't lower myself to the same level as the seller. But don't worry James ... My old man always says what goes around comes around.

I was on ebay this evening and released you could reply to the decision message within your account. There is no reply link in the same message sent to your email. Which is why I thought end of story. This is what I wrote an hour or so ago... May be it is not over yet?

Thank you for finding the case in my favour. However, to send the Toy back to the USA with full tracking and insurance will cost me as much as I paid originally for the item as a courier will need to be used to send it from Ireland where I am currently working back to the seller.

To accept this offer will put me in a worse off position: I will be returning the Playset, Paying its value in postage all just to receive a similar amount back. This would be like me giving the set away for free to someone else. Can I ask why my plea for a partial refund of the purchase wasn't granted?

I did reference my post on in the original emails. This shows my case fully, including details on the missing catalogue and damage caused by the seller to the box, it also contains all the correspondence between me and the seller including his inconsistent reasoning and statements from one message to the next.

The catalogue is not as easy as the seller makes of to get. Kenner the maker of the highly collectable Toy had to make a special dual language (English and French) version of the Catalogue for the Canadian release. It is very hard to come by compared to the USA version which is much more common.

Because I received the exact Playset shown in the seller’s auction I am utterly convinced he has removed the catalogue before sending the Playset to me (squashed). All I ask for is a reasonable amount of partial compensation so that I may put it towards getting a replacement dual language (Kenner Canada) Catalogue when and if an opportunity arises. Thanks again for all you help so far, Craig

I just noticed you left him a negative Smile With him dropping below 98% that closes the door on alot of options of upgrading his account ect and will take considerable effort to recover to a 'trustable' position on ebay, i know its not a lot of compensation but its what he deserved Smile

P.S. ive added the catalogue to my daily searches Smile
